In the transition to the market economy, there are many instances of
anticompetitive behaviors such as the bid rigging below.
These are not difficult to understand.
In this case, the bidders conspired to rip off the entity letting the bid,
presumably an SOE, by creating a win-win situation for themselves.
Usually, an SOE does not care much about the bottom line and would not
bother to wonder why there are no high bids.
But there are some flies in the ointment for this case. There are too
many bidders, making it too expensive for the rigged bid winners to offer
a higher pay off. The true cost of the winning bid would be the
minimum/initial bid (VND 4 billions) plus the payoff amount times 34. Also
there is a sense of entitlement by the local bidder.
Vietnam does have a competition law it can use to deal with this case, in
addition to the criminal code for the murder.

Dear CACC,
This case involves a bidding session for a service contract and there was
a physical fight and the winning bidder got killed by a competitior group
on site. I hope the court will issue some stiff sentence for these guys.
But here is another more important issue in the case--that is the bidding
procedure. The initial price for the bid is 4 billion dong, each bidder
has to put down 100 million dongs. There are 35 bidders. One bidder
proposes to give the other 34 bidders 10 million dong each, so that they
will let him win the bid. Another bidder increases the bid to 20 million
dong for each (of the 34 other bidders).
I thought bidding means you bid for the contract price, say, I bid 4,2
billion dong for the contract, you try to beat me by bidding 4,5 billion
dong, another guy try to beat you by increasing it to 5 billion dong. That
is bidding.
But here the "bid" is that I pay all 34 of you 10 million dong each so
that you all go away, another guy "bids" up $20 million dong for each
person to go away.
Is this really true, or I just misunderstand what I read? It it's true,
then this is NOT bidding. This is a conspiracy by a group of competitors
to FIX PRICE. It is similar to 5 rice companies sitting together and one
guy says: I propose that we all charge 30 thousand dong per kilo and I
will give each of you 5 thousand dollars if you agree with me. This is a
conspiracy to FIX PRICE to cut the consumers' throat.
This kind of practice is called "agreement (or conspiracy) to fix price"
and is the most serious anti-trust violation. In antitrust lingo it is
called "horizontal price fixing" or "horizontal agreement not to compete."
It is also called an "unfair competition." The first cardinal
antitrust (competition) sin.
Can we start to get people to understand what competition means? A free
market cannot survive if people are free to fix prices. The FOUNDATION of
the free market is COMPETITION, folks.

Công an tỉnh Ninh Bình vừa khởi tố điều tra vụ đâm anh Nguyễn Văn
Hồng (người tham gia đấu giá ở Công ty Vận tải thủy số 2), bắt
đại diện một nhà thầu và 4 người khác về hành vi giết người.

Công ty Vận tải thủy số 2 Ninh Bình cho thanh lý 15 sà lan và 4 tàu
kéo với giá khởi đầu gần 4 tỷ đồng. Chỉ trong một thời gian ngắn
đã có tới 35 hồ sơ xin dự đấu thầu.
Theo quy định, mỗi đơn vị phải đặt cọc trước 100 triệu đồng.
Sáng 13/3, tại trụ sở của Công ty Vận tải thủy số 2, thành phố
Ninh Bình, các nhà thầu đến nộp tiền đặt cọc. Một nhà thầu đề
nghị: "Tôi sẽ đưa cho 34 hồ sơ còn lại mỗi hồ sơ là 10 triệu
đồng, mọi người hãy nhường lại quyền thắng thầu cho tôi".
Nguyễn Văn Hồng, chủ buôn sắt vụn tại địa phương phản đối: "Tôi
là người Ninh Bình, phải để cho dân Ninh Bình trúng thầu. Cho mỗi
người 5 triệu đồng rồi biến".
Một thầu khác liền phát giá: "Cho mỗi hồ sơ 20 triệu đồng". Mức
"hoa hồng" được đẩy lên vùn vụt, những người dự thầu không ai
chịu ai.
Trần Hải Nam, đại diện Công ty TNHH Dịch vụ thương mại và XNK
Thiện Toàn (ở Hải Phòng) nói với anh Hồng: "Ông béo ơi, cùng cánh
làm ăn cả, nên lịch sự một tí. Người ta đưa ra giá 20 triệu đồng
rồi đấy...".
Bị kích động, hai người cãi nhau ầm ĩ. Anh Hồng chạy ra xe ôtô lấy
ống tuýp nước vào vụt Nam. Thấy vậy, nhóm đàn em của Nam đứng gần
đó, mỗi người một con dao xông vào đâm anh Hồng khiến tử vong. Nhóm
của Nam bỏ trốn.
Một ngày sau khi vụ án xảy ra (14/3), Vũ Văn Khánh (lái xe chở Nam và
đồng bọn đi trốn) đã ra đầu thú. Ngày 22/3, người thứ hai trong
nhóm này là Bùi Bảo Anh cũng tới cơ quan công an thú nhận toàn bộ sự
việc.
Theo lời khai, Trần Hải cùng lái xe Vũ Văn Khánh đi từ Hải Phòng đến
Ninh Bình tham gia đấu giá. Trên đường đi, Nam bảo Khánh đón ba thanh
niên nữa (gồm Bùi Bảo Anh là em cùng mẹ khác cha với Nam và 2 người
khác đều là bạn của Bảo Anh).
Sau khi gây án nghiêm trọng, Nam bảo Khánh lái xe chở cả bọn trốn
về Hải Phòng. Trên đường đi, Nam đưa cho mỗi người 200.000 đồng
và cứ đi 5 km thì thả một người xuống dọc quốc lộ 10, còn Nam
xuống sau cùng.
Ngày 5/4, Công an tỉnh Ninh Bình đã khởi tố vụ án và khởi tố 4 bị
can về tội giết người, gồm: Bùi Bảo Anh, Phạm Văn Toàn, Phạm
Thành Nam, Trần Hải Nam.
Ba người khác được xác định có liên quan vụ việc đang lẩn trốn,
cơ quan điều tra đã ra lệnh truy nã toàn quốc.
