Dear anh Hoanh et al,
As long as they live in Vietnamese territory, they have to abide by 
Vietnamese law.  Ethnic customs do not trump national laws.
But first, the national law involving this aspect has be clearly 
established and the case carefully analized before legal actions can be 
taken.
Of course the national government should do everything possible to educate 
people about the law, what it actually says, the penalty, etc.  It should 
also educate at a broader level so the victim understands her rights and 
legal recourse.   But for all the laws in the book, the victim is still 
unlikely to be able or willing to bring a case. The State may have to step 
in to bring to trial a few initial cases to set precedence.  But it has to 
choose the most egregious cases to prosecute. To be fair, this type of 
phenomenon is not necessarily just ethnic.  It was widely practiced among 
the Kinh until fairly recently, albeit without the ceremonial aspects of 
cung ma.  It's called "tao hon" or early marriage.  It's not considered 
criminal then.  I consider it more a symptom of under development.
Here is another example of how what comes out of the right heart may not 
be "right".  The parents of the victim will say that they love their 
daughter dearly and only want the best for her, but still manage to hurt 
her by their action.
The article over simplified things by failing to explicitly point out that 
in order for a "kidnapping/rape" to occur, there has to be some tacit 
agreement among the couple's relatives.   It may be against the girl's 
will, but not everyone's.  The article did say that the man had permission 
to bring the girl home, so it's over reaching to conclude that this is 
"obviously kidnapping and rape under Vietnamese law".

Dear Everyone,
 
I am posting this message to both VNBIZ and VNPH.
 
This is a legal and health issue involving an ethnic minority's custom. It 
appears from the following VNexpress article that among the Tha'i people, 
when a girl, usually teenager of 14 or 15, is caught by a man's family and 
ceremonially forced into sexual intercourse with that man, she becomes the 
man's wife, against her will and everyone's will.   That is obviously 
kidnapping and rape under the Vietnamese law and the law of most countries 
on the planet.  But that is the culture of an ethnic group.  Of course, we 
want to respect the ethnic minorities' customs. 
 
What do you suggest the government should do?

Cướp làm vợ ở tuổi vị thành niên
Vừa bước vào sân, Lô Thị Hương (dân tộc Thái), 14 tuổi đã bị cả 
gia đình Hùng bắt vào làm lễ nhập gia. Thầy cúng thắp hương khấn 
vái tứ phương phù hộ cho cô dâu mới...
Tại THPT nội trú huyện Quỳ Hợp, nhiều nữ sinh rơi vào cảnh tiến 
thoái lưỡng nan khi bị cướp về làm vợ ngay lúc đang đi học và còn 
ở độ tuổi vị thành niên. 
Lô Thị Hương, trú tại xã Châu Cường, Quỳ Hợp (Nghệ An) kể, lúc 
Hương gần 14 tuổi, Lương Quang Hùng ở xã Châu Lý là một thợ mộc 
đến giúp bố cô đục gỗ làm nhà. 
Một lần, Hùng xin phép gia đình rồi nhờ Hương chở về giúp mẹ Hùng 
cấy lúa. Khi vừa đặt chân đến, mọi người trong gia đình liền giữ 
lại, tổ chức cúng ma và bắt Hương ở lại luôn. Từ đó cô trở thành 
một người vợ bất đắc dĩ của anh chàng thợ mộc. 
Cảm giác những ngày đầu bị bắt về làm vợ vẫn còn đau đáu, Hương 
run rẩy nói: "Đêm hôm đó, Hùng uống rất nhiều rượu của trai làng 
đến chúc mừng, sau đó hắn bắt em làm chuyện ấy. Đau đớn, sợ hãi 
nhưng em làm gì được trong căn buồng kín. Đến 15 tuổi em đã có con 
đầu lòng...". 
Anh Nguyễn Minh Đạt, Bí thư Đoàn Trường THPT Dân tộc nội trú Quỳ 
Hợp cho biết, trong năm qua ở đây đã có một số học sinh bỏ học vì 
bị bắt về làm vợ. Nhà trường đã có nhiều văn bản gửi các cơ quan 
chức năng ngăn chặn tình trạng cướp vợ ở trường học, nhưng tình 
trạng này vẫn tiếp tục xảy ra. 
Ông Quang Văn Nghiệp, công an xã Châu Tiến, Quỳ Hợp phân trần: "Theo 
tục ở đây, nếu đã cúng ma, nhập gia rồi thì họ phải đến với nhau, 
không thể khác được. Dù xã không cấp giấy đăng ký kết hôn thì thực 
tế họ cũng sống và đã là vợ chồng của nhau".
