[Vnbiz] Students studying in smoke

Dear CACC,

This VNExpress article is about some very interesting issue.  For about a
year now, there appear right outside the fence of Tran Quoc Toan Primary
School in Quy Nhon many little altars with incense burning producing quite
abit of smoke that bothers students and teachers in the school, and many
have to close doors and windows while studying.  (Please see article and
picture below).  And no one seems to take care of that situation.

I have the feeling that the school and the local authority don't want to
touch the issue because it may involve claims for "violation
against religious freedom."  This could be another demonstration of  the
fact that most local authorities still don't know how to manage problems
that may involve some claim about "religion."

The real cause of this kind of ignorant and clumsy governance is that at the
national level (1) there is still a  very low level of understanding on how
to manage issues involving religion and (2) the law is still not developed
enough to handle social society, i.e., non-profit organizations, including
religious organizations and their activities.

Providing a good legal frame work for non-profit organizations (civil
society) has been a major issue of Vietnam for the last several decades, and
the entire world has talked about it often enough.  However, the government
and the VCP very much take their time going at the turtle speed on this
issue.  This hurts all efforts to organize voluntary, charitable works in
Vietnam at every level and dampens the people's volunteerism greatly.

Anyway, in this case the issue is fairly simple:  The place outside the
school is not the place where anyone can just put an altar and burn
incense.  The school problaby can sue for tresspassing or pulic nuisance or
both.  The government can sue for putting an altar on the walk
way.  Whatever the legal theory is, you just can't simply put a bunch of
altars right outside a school like that.

Hàng trăm học sinh học trong cảnh khói hương

Hơn một năm nay, hàng trăm học sinh tiểu học Trần Quốc Toản (thành phố Quy
Nhơn) sống trong cảnh lư hương tràn ngập từ cổng trường đến sát cửa sổ phòng
học. Phòng học phải đóng cửa do khói hương xộc nghi ngút, khiến học sinh và
giáo viên không chịu nổi.    Hàng ngày, học sinh phải ra vào đối mặt với
những lư hương, trang thờ. Ảnh: *Thanh Niên.*Một số người dân sống gần Tiểu
học Trần Quốc Toản (cơ sở 2), phường Đống Đa, thành phố Quy Nhơn, Bình Định,
cho biết, một năm trở lại đây, khuôn viên trường bỗng nhiên xuất hiện hàng
loạt lư hương, trang thờ, nhưng chẳng thấy ai đến giải quyết, học sinh thì
vẫn phải lui tới học mỗi ngày.

Hầu hết học sinh đều rùng mình lo sợ khi được hỏi về cảm giác "học trong
cảnh khói hương nghi ngút" . Giờ ra chơi, các em không dám bén mảng tới gần.
Mỗi khi vào lớp hoặc ra về, đi ngang qua cổng trường, em nào cũng bước
nhanh, né xa những lư hương, trang thờ cách lối đi chỉ vài gang tay.

Theo Ban giám hiệu tiểu học Trần Quốc Toản, hiện tại, trường có 5 lớp (khối
4 và khối 5) với hơn 140 học sinh. Mới đây, một phòng học đã phải đóng cửa
do khói hương xộc nghi ngút vào phòng, khiến học sinh và giáo viên không
chịu nổi.
