  2.  Background
   
  The European Technical Assistance Programme for Vietnam (ETV2) is a technical assistance umbrella programme funded by the European Commission for a total amount of EUR 11 034 800 which aims as supporting the main financial and economic institutions (Ministry of Finance and Ministry of Planning and Investment) and the Ministry of Science and Technology of the Government of Vietnam in supporting their present reform drive within the framework of 2001-2010 socio-economic strategy plan and in line with the Comprehensive Growth and Poverty Reduction Strategy (CGPRS). It started at the end of 2005 and will continue until August 2008.  
   
  The project overall objective is to improve the economic and social development in Vietnam during its period of transition to a market economy. It aims at enhancing better decision making in the public and private sector and the development of clear, rational, transparent policies, strategies, plans and legislation through a strengthening of policy/legislation making capacity and of means of implementation.
   
  The specific objectives of ETV 2 is to provide technical assistance, expertise and services in an effective and efficient manner with a view of enhancing, strengthening and improving:
   
  1.      To enhance capacity for raising domestic revenue at the Ministry of Finance for all major revenue sources at all levels (implemented through components 1 to 3);
   
  2.      To strengthen policy making and to develop and apply related tools for implementation (implemented through components 1 to 3);
   
  3.      To improve auditing/accounting and insurance legislation and develop related standards in line with international ones (implemented through component 4);
   
  4.      To improve information management, monitoring systems and statistical analysis at the Ministry of Planning (implemented through component 5);
   
  5.      To create confidence in the process of Measuring, Standardisation, Testing and Quality (implemented through component 6).
   
  The results proposed under the ToRs are as follows:
   
  -          Increased revenue raising capacities as a consequence of an improved policy making process;
   
  -          Effective taxation / custom laws and procedures and a fair and equitable tax collecting system;
   
  -          The completion of legal frameworks for accounting, auditing and insurance in accordance with international standards;
   
  -          Accurate statistical analysis, forecasting and monitoring to support policy decision making process;
   
  -          A legal framework for standards and quality assurance in line with international standards; establishment of national normative corpus completed.
   
  In order that its objectives can be fully achieved, the programme is divided into six project components:
   
  -          Component 1: Fiscal Policy and Legal Advisory Services
   
  -          Component 2: Taxation
   
  -          Component 3: Customs
   
  -          Component 4: Accounting, Auditing, Insurance
   
  -          Component 5: Statistical Analysis, Policy Tools
   
  -          Component 6: Standards and Quality Control 
   
  The overall project period (3 years) and related activities can be divided into two phases, an inception phase of 10 months (December 2005 to September 2006) and the main operational phase (from October 2006 to August 2008).
   
  Programme Organization
  The Executing Authority of the project is the MPI, Ministry of Planning and Investment while the Implementing Authorities are the Ministry of Finance, the Ministry of Science and Technology.   Component 3 Customs is in charge of:   
  -          Development of Customs Laboratory Legislation
   
  -          Development and Implementation of a Customs Laboratory Reorganisation Plan
   
  -          Development and Implementation of Customs Laboratory Training Guidelines
   
  -          Development and Introduction of Customs Laboratory Management & Staff Instructions
   
  -          Carrying out a systematic assessment of the issues to be addressed by the GDVC in implementation of the WCO Framework
   
  -          Carrying out a fact-finding study to assess the implications of the WCO Framework
   
  -          Carrying out a detailed review of legislation that needs to be revised, or implemented, in accordance with WCO Framework obligations and commitments
   
  -          Development of Customs control guidelines and procedures that need to be introduced in order to comply with WCO Framework obligations and commitments
   
  -          Raising awareness of WCO Framework requirements
   
  -          Development of an Authorized Economic Operator scheme in accordance with the WCO Framework
   
  -          Assisting with the implementation of Mutual Administrative Assistance in customs matters
   
  -          An evaluation of Non-Intrusive Customs Detection Equipment requirements
   
  -          Establishment and training of a Single Window Working Group
   
  -          Development of a Single Window Strategy
   
  -          Carrying out a feasibility/ fact-finding study for the establishment of the Single Window strategy
   
  -          Development of a Single Window Action Plan
   
  -          Delivery and evaluation of a Single Window awareness campaign for GDVC managers and staff, and trade/ public stakeholders
   
  -          Development and assessment of a Single Window pilot site
   
  -          Design and delivery of practical training in search techniques (road vehicles; ships; aircraft; railway traffic)
   
  -          Design and delivery of practical training in interviewing techniques
   
  -          Production of written guidance on search and interviewing techniques
   
  -          Designing and delivering a ‘Train-the-Trainers’ course for GDVC Anti-Smuggling trainers designed and delivered
   
  -          Design and supervision of a ‘live’ operational exercise conducted by GDVC Anti-Smuggling personnel
   
  -          Assessment of Anti-Smuggling equipment needs and supply of equipment
   
  -          Review of existing legislation on IPR enforcement procedures
   
  -          Development and implementation of reorganisation plan for IPR enforcement operations
   
  -          Development and introduction of new guidelines and procedures for IPR enforcement operations
   
  -          Development and implementation of IPR training guidelines
   
  -          Development and introduction of IPR enforcement management and staff instructions.
   
  3.  Scope of Work / Expected Work Contribution
   
  3.1.      Overall objectives
   
  The National Short Term Expert will be responsible for assisting the International Short Term Expert and Key Expert 5 in undertaking a high level assessment covering the full range of the issues to be addressed by the General Department of Vietnam Customs (GDVC) in the implementation of the WCO Framework to Facilitate and Secure Global Trade (“WCO Framework”) as per Activity C3-WCO1 detailed in the OWP.  He/she will work under the supervision of the International Short Term Expert.
   
  3.2.      Specific objectives
  The specific objective of the review is to assist the GDVC in identifying the needs and to provide a foundation for undertaking the reforms necessary to implement the WCO Framework. The intended outcome is to increase the degree of information and improve the capacity of the GDVC and other relevant departments to understand WCO Framework obligations and commitments and their legislative, ICT and procedural implications, with a view to meeting WCO and APEC obligations and commitments; and to identify at a high level the required sustainable capacity building measures including the modifications to national legal and administrative rules and procedures, where appropriate leading to the implementation of the provisions of the WCO Framework. The beneficiaries of this activity include the GDVC, other relevant government ministries and Business.
  3.3.      Results to be achieved by the National Short Term Expert
   
  The National Short Term Expert will achieve the following results as part of this assignment:
   
    
   Assist the International Short Term Expert to identify the required sustainable capacity-building measures, including the modifications to national legal and administrative rules and procedures leading to the implementation of the provisions of the WCO Framework.  
   Assist the International Short Term Expert and Key Expert 5 to prepare an analytical report with concise matrix of possible legislative, ICT, procedural and capacity-building implications associated with the implementation of the WCO Framework in Vietnam.   
   Translate the report from English into Vietnamese.
  3.4       Geographical area to be covered  Meetings will be held at the GDVC Project building and at locations in the environs of Hanoi. A field trip outside of Hanoi is also envisaged.
   
  3.5       Specific activities   
  The activities of the National Short Term Expert will be the following:
   
    
   The National Short Term Expert will translate and/or supervise the translation into Vietnamese, as appropriate, of legislation and documents pertaining to the WCO Framework.  
   The National Short Term Expert will act as an interpreter, as appropriate, at meetings with representatives from the GDVC and Trade Associations to discuss the implementation of the WCO Framework.  
   The National Short Term Expert will translate and/or supervise the translation into Vietnamese, as appropriate, of an analytical report with concise matrix of possible legislative, ICT, procedural and capacity-building implications associated with the implementation of the WCO Framework in Vietnam.
   
  3.6              Management of the Assignment
  The National Short Term Expert will work under the supervision of the International Short Term Expert who will review all working papers, translations and presentational material prepared by the Local Short Term Expert. 
   
  The ToRs of the National Short Term Expert and the CV are approved by the EU Delegation, the Component 3 PTF Director and the EU Team Leader.
   
  The Component 3 Coordinator, Mrs. Mac Le Thu Hong, will assist the National Short Term Expert throughout the duration of the assignment.
   
  The National Short Term Expert will report to the International Short Term Expert, Component 3 PTF Director and Key Expert 5.
   
  4.         Scope of Work / Expected Work Contribution
   
  Qualifications and Professional Experience:
    
   A university degree, or equivalent qualification  
   At least 10 years’ experience working in a legal or customs related role.  
   Knowledge of the WCO Framework to Facilitate and Secure Global Trade is desirable.
   
    
   Previous experience of translating customs reports and terminology into English.  
   Previous experience in devising customs instructions and operational guidelines.  
   Excellent communication and presentation skills, both oral and written.  
   Vietnamese mother tongue and fluent in written and oral English
