NEW YORK (AP) -- Vietnam's ambassador to the United Nations is claiming
diplomatic immunity after being accused of illegally digging for clams on Long
Island.
Ambassador Le Van Bang and his driver, Toan Nguyen Dinh, were spotted July
31 in East Hampton's Hog Creek, carrying plastic bags filled with clams, town
officials said.
The two men "acted like they didn't speak English when they were confronted
by the harbormaster," said the town prosecutor, Scott Allen.
After police were called, Le and Toan dropped the bags of clams and claimed
diplomatic immunity, the Daily News reported Friday.
The men were ticketed for illegal shellfishing and littering. Clamming
without a license carries a $250 fine. The men are due in town court Oct. 3.
Allen is researching whether diplomatic immunity applies.
"Apparently, there are two different levels of diplomatic immunity," Senior
Harbormaster Bill Taylor said. "The ambassador is total diplomatic immunity,
the driver may be at a different level."
Nguyen Thi Hong, a spokesman at Vietnam's U.N. mission, said the incident
was a misunderstanding.
"They were not picking up clams. They were just swimming around," he said.

To the DISHONORABLE Le Bang,
We regret to hear about your arrest for stealing public clams by the
local New York authority. It is yet another proof of the US imperialists
harassment; the war is over, but they continue to attack your private
enterprise effort, in this case, collecting public clams for your own
meal.
We agree with you that the local clamming law is not fairly enforced:
it did not consider public official, party member, or those who helped
and contributed to the revolution any differently.
This could not happen in CHXHCNVN. We in CHXHCNVN always treat
party members, government officials with the highest respect,
along with special privileges and most of all, above the law.
And we don't even wait until night falls to enact our law:

Our VN model, which you are a living proof of the
supremacy of socialist society (u+u vie^.t cu?a xhcn). You represent

instilled in and passed on by great great Uncle Ho. Your highly
visible position of CHXHCNVN ambassador to the UN is a testimony
to that fact. And your quick-minded reaction to the local police has
confirmed to us that you have reached "the zenith of human
intelligence" (ddi?nh cao tri' tue^. loa`i ... cho^m chi?a), an achievement
only our VCP could accomplish.
It is obviously ridiculuous to charge that you are stealing the
clams on a public beach. With your position, power and money,
you can have all the clams that you ever want, so why have to
steal anything at all. Some said that it's
come from the trained habit of party cadres, that forbidden fruits
taste better (a(n vu.ng ngon ho+n a(n tha^.t). That's hogwash. The
truth of the matter is you and your driver were going for a midnight swim in a cold and
deserted public New York beach. And along the way, you were
trying to do a good deed by cleaning the beach of these
delicious clams. You should be rewarded instead of prosecuted.
Of course, when the port authority arrested you, you were in
such a shock that you were no longer able to speak English. This is
perfectly reasonable. Facing such a life threatening situation,
others have even become speechless, but with your training, you
surpassed these people by at least able to speak Vietnamese,
just temporarily forgot English. Many were confused that you were
trying the "No Speak English" trick, and hoped that the port
authority would think that you are an uneducated, unknowing
immigrant and would have mercy and let you go. There is no truth
to such allegation.
The whole incident is just an attempt to smear such a law
abiding, honesty and integrity person such as you. It is also
just a conspiracy of the outcasted Vietnamese oversea to insult
and paint a bad picture about you and the regime you
represented. The truth is you and your driver were just swimming
around at midnight in a freezing beach, no more no less.
In any case, we would like you to know that no matter what
happened, we believe in you, and wish you the best. Of course, if
the Central Committee decides to recall you and let you "mo` to^m",
we'll make sure that your name and your infamous act of "mo` so`" will
have its own place in VN history: You will forever be known as "the
first 'mo` so`' ambassador of the SRV."
